General Sales Conditions (GSC) for purchases effectuaed online on the website www.gpsmele.it or www.gpsmele.com Mele Fashion s.r.l. Mele Fashion s.r.l. invites all users to read the following General Sales Terms and Conditions("GSC") that regulate the products’s purchases as well as the orders’ management process. On the website www.gpsmele.it, both "GPS Mele Products" and "Mele Fashion Partners products" are on sale. The offer and sale of the products listed on our website ("www.gpsmele.it") are regulated by the following General Sales Terms and Conditions. You can also request any further information through our support services (see contact us). Customers can also consult our Customer Service Area where information (related to orders and shipments, refunds, and returns) are published in details. For any other legal information, consult the sections: General Conditions of Use, Privacy Policy and Return Policy.

1. Our code of ethics and commercial policy

1.1 The Seller, through its websites www.gpsmele.it and www.gpsmele.com, offers for sale the products and carries out its e-commercial activity exclusively in function of its end users who are "consumers".

1.2 By "consumer" we refer to any person who interacts on www.gpsmele.it for purposes not related to his commercial, entrepreneurial or professional activity. If you are not a "consumer", please contact us before concluding commercial transactions through www.gpsmele.it.

1.3 In compliance to its code of ethics and commercial policy, the Seller reserves the right to cancel orders that do not meet the traceability and safety requirements and also reserves the right to request copies or photos of identification documents. In addition, the seller reserves the right not to process orders from users other than the "consumer" or orders that do not comply to its commercial policy.

1.4 The present General sales terms and conditions regulate the offer, process, and acceptance of purchase orders for the products on gpsmele.it between users of gpsmele.it and the Seller.

1.5 The General Sales Conditions do not regulate the supply of services or the sale of products by sellers, that are present on gpsmele.it through links, banners, or other hyperlinks, other than the Seller. It is highly recommended to check the sales conditions of other parties before forwarding orders and purchasing products and services to other parties other than the Seller, knowing that the Seller is not responsible for the quality of services provided by third parties or for the conclusion of electronic commerce transactions between the users of gpsmele.it and third parties.

1.6 By clicking on "Buy ", the customer places a binding order on the items contained in the virtual shopping cart. Once the order has been submitted, GPS Mele will send an order confirmation email to the customer within 1 hour. The purchase contract is concluded between the two parties when the customer receives the order confirmation. If the customer does not receive any order confirmation within the time frame indicated in the present art. 1.6., the concerned order shall be then considered as rejected by GPS Mele without any consequent effect. Orders for which the customer has opted for an advance payment will be dispatched as soon as GPS Mele receives the total payment composed by the purchase price and eventual shipping costs. GPS Mele therefore invites the customer to pay the amount as soon as the order confirmation is received or maximum within the following 7 days.

1.7 In the case of non availability of the products for reasons not attributable GPS Mele’s conduct, the customer shall be promptly notified. In this case, GPS Mele will not be obliged to deliver the ordered goods , except in the event that GPS Mele has taken on the supply risk in relation to the products that compose the order. In any case, if the ordered products are not available, GPS Mele will, without any delay, reimburse, in favor of the customer, any paid amount.

1.8 GPS Mele does not assume the responsibility to research and find unavailable products from other sources. The current article applies also to orders relating to fungible goods (for which only the product type and characteristics are described). GPS Mele is obliged to deliver what is in stock and what has been ordered from its suppliers. GPS Mele effectuates deliveries only in Italy. For deliveries outside Italy GPS Mele will evaluate and propose the best means on a case by case basis. When the delivery time is generally expressed in working days that, in turn, includes the days between Monday to Friday and excludes holidays.

2 Prices, shipping costs and express delivery

2.1 The customer is required to pay the price published on the product page at the time of purchase order. The indicated price is final and inclusive of VAT.

2.2 Shipping costs are at the expense of GPS Mele only when specified. Otherwise they are at the expense of the buyer at indicated cost.

3 Payment

3.1 GPS Mele accepts different payment methods including: credit card, Paypal. GPS Mele reserves the right to decline certain payment methods and to request different payment methods for certain orders.

3.2 In the event of a purchase effectuated through a credit card or through Paypal, the customer will be charged immediately.

3.3 The buyer shall agree to receive invoices exclusively in electronic format.

4 The use of promotional vouchers

4.1 Promotional vouchers cannot be purchased, they are offered by GPS Mele as part of promotional campaigns and can be used for a limited period of time.

4.2 Promotional vouchers can be used only once, in function of a single order, and within the specified period of validity. The possibility of using promotional coupons may be excluded for the purchase of certain products. Furthermore, promotional vouchers cannot be used to purchase gift cards. The use of a promotional voucher is sometimes subject to a minimum expenditure amounts.

4.3 The value of the purchased products must be equal to or greater than the value of the promotional voucher. If the amount of the promotional voucher is not sufficient to cover the value of the ordered products, the difference can be paid through other accepted payment methods included in the previous article that refers to Payment methods. Promotional vouchers are not refundable in cash and no interests shall be considered on the concerned credit. Promotional vouchers are not refundable in the circumstance where buyer decides to return all or part of the ordered products.

4.4 Promotional vouchers can only be used if the order is finalized. They cannot be used retroactively and cannot be transferred to third parties. Unless otherwise accepted by GPS Mele, it is not possible to accumulate several promotional vouchers for the same purchase order.

4.5 GPS Mele reserves the right to invoice the original price of the goods, that remain in the customer's possession, in the event where the customer has used a promotional voucher during the purchase order of which value results higher after a partial withdrawal effectuated by the customer.

6. Wihdrawal right for GPS Mele Products The customer has the right to withdraw from any order related to GPS Mele Products, without providing any reason, provided that it is explicitly requested to GPS Mele. If the customer intends to return the purchased products, he can use the return label received with the order or can print a new one via his personal page accessible from GPS Mele website. If the customer does not have access to a printer or has problems downloading the return label or needs a new label, the contact Customer Service (see the contact details indicated at the bottom of the page) can be contacted to request a new label. Please always use the return label provided by GPS Mele in order to avoid unnecessary additional costs. It is worth mentioning here that once the registration is completed, the Customer can select one or more Products that to purchase and can place them in a virtual "cart", of which content is always viewable before forwarding the actual order.

6.1 Information related to the withdrawal right (pursuant to article 49, paragraph 1, letter (h) of Legislative Decree no. 206/2005 "Consumer Code") The customer has the right to withdraw from the contract, without indicating the reasons, within 14 days from order delivery. The withdrawal period expires after 14 days starting from the day on which the customer or a third party, other than the carrier, acquires physical possession of the last good ordered. In the case of a contract referring to multiple goods ordered by the customer in one order and delivered separately, the 14-day period starts from the day on which the customer or a third party, other than the carrier, acquires physical possession of the last good. To exercise the withdrawal right, GPS Mele must be informed (Mele Fashion srl Via Luigi Ciminelli 23, Francavilla in Sinni 85034 PZ fax: +39 0973 644335, e-mail: info@gpsmele.it) about the customer’s decision to withdraw from the contract through an explicit declaration (such as a letter sent by post, fax or e-mail). It is also possible to send an explicit declaration of withdrawal electronically. In this case, GPS Mele will immediately send a receipt confirmation related to the withdrawal by e-mail. The deadline set for the withdrawal is considered respected if the customer sends his declaration before the expiry of the 14-day term starting from the day on which the customer or a third party, other than the carrier acquires physical possession of the last ordered good. In the case of a contract referring to multiple goods ordered by the customer in one order and delivered separately, the 14-day period starts from the day on which the customer or a third party, other than the carrier, acquires physical possession of the last good.

6.2 Effects related to contract withdrawal Mele Fashion will reimburse all payments effectuated by the buyer with the exception of delivery and/ or collection costs (and any additional costs related to the choice of carrier company different from the standard one offered by Mele Fashion), without undue delay and in any case no later than 14 days from the day on which GPS Mele is informed by the customer’s decision to exercise the withdrawal right. These refunds will be effectuated through the same payment means used by the customer during the purchase phase, unless otherwise agreed. In any case, the customer will not incur any costs as a consequence of this refund. The refund can be suspended until GPS Mele receives the returned products or, if priory agreed, until the customer demonstrates that the concerned goods have been shipped. The customer is required to return or deliver the products without undue delay and in any case within 14 days from the day on which he communicated his intention to withdraw from the sales contract. The Products must be returned - packaged correctly in their original packaging, not damaged, and equipped with any original components and/or accessories, use instructions, and documentation and labels; - equipped with the transportation document (present in the original packaging), so as to allow GPS Mele to identify the customer (Order number, name, surname and address); - without any evident signs of use, if not those compatible to carrying out a normal test of the article (they must not show traces of prolonged use exceeding the time necessary for a test and must not be in a state that does not permit the resale). If the returned product does not comply with the provisions of the previous paragraph, the withdrawal will not be effective. The costs of returning the goods are at the expense of the customer / buyer. The customer is responsible for any decrease in the goods value resulting from a wrong manipulation of the goods other than what necessary to establish their nature, characteristics and functioning.

9. Refund Invoices will be issued exclusively in electronic format, where possible hard copies will be included in the package.

9.1 Refunds are accredited directly to the account or payment method used at the purchase. For payments effectuated through Paypal or credit card, the refund will be effectuated to the same Paypal account or credit card account.

11. Warranty for product defects and additional information

11.1 The Consumer code rules apply to purchases carried out on gpsmele.it regarding defects and product defects guarantees. The customer is, therefore, entitled to the rights referred to in art. 130 of the Consumer Code. These rights must be exercised in the terms set out in art. 132 of the same Consumer Code.

11.2 These GSC can be consulted on the website www.gpsmele.it and can be saved using the relative browser command (usually File -> Save As). You can also save and archive them in PDF format by clicking here. In order to open the PDF file, Adobe Reader must be installed on your computer, which can be downloaded for free from the website: www.adobe.it, or other similar software.

11.3 It is possible to archive the order details and download the GSC using the relative browser command to save the order summary that appears on the last screen of the purchase process, or wait to receive the automatic order confirmation message that GPS Mele sends via email at the completion of the order. This confirmation message includes the order details and the GPS Mele GSC, and can easily be printed or saved using the functions made available by e-mail programs.

12. Applicable law

12.1 The present GSC and purchase and sale contracts are regulated by Italian laws (in particular, they are regulated by the Consumer Code regulating contracts at distance under articles 46 to 67 - and by Legislative Decree 70 of 09/04/2003 regulating e-commerce).

12.2 For any dispute that may arise in connection to the GSC and / or purchase and sale contracts, customers will be able to activate an out-of-court dispute resolution procedure in accordance with the requirements foreseen by the Consumer Code articles 141 et seq.

12.3 The Customer also has the right to use the online dispute resolution procedure available on http://ec.europa.eu/consumers/odr/
